What is Child Custody?
Child Custody can be broken done in two distinct parts- legal and physical. Legal Custody refers to which parents has the right to make health, education, and other important decisions for the children. Physical Custody refers to the parent who has physical custody of the child the majority of the time. Commonly, parents are granted Joint Legal meaning both have the right to be involved in the health, education and other important legal decisions for the children.
What is Child Visitation?
Child Visitation refers to the specific parenting arrangement between two parties. Some aspects include holiday schedules and specific days and times one parent may have Visitation.
How do I get a Child Custody and Child Visitation Order?
There are a couple different avenues to obtaining these Orders. The first one is negotiating with the other parent or the other attorney. The second one is preparing a Motion to file with the Court to request Court Orders. As part of this Motion, Family Court Services may be scheduled. Family Court Services allows both parties to sit down with a neutral Mediator to try to come to an agreement. If no agreement is reached, the Mediator will issue a Family Court Services Report and Recommendation. This Recommendation will be sent to both party’s and to the Court for review.
Court Orders relating to Child Custody and Child Visitation are crucial and proscribe how the children will be shared. This can affect the children’s place of residence, school, and other aspects of the child’s life.
